सीमित दायित्व साझेदारीको दर्ता प्रक्रिया

हो, कुनै पनि एलएलपीले निम्न दुईमध्ये कुनै उपाय अपनाएर भारतमा आफ्नो व्यवसाय बन्द गर्न सक्छ:

1 एलएलपीलाई काम नगरेको घोषित गरेर: यदि एलएलपीले आफ्नो व्यवसाय बन्द गर्न चाहेमा वा यसले एक वर्ष वा सोभन्दा बढि अवधिमा कुनै पनि व्यवसाय सञ्चालन गरिरहेको छैन भने, यसले एलएलपीलाई काम नगरेको घोषणा गर्नका लागि र यसको एलएलपीको रजिस्टरबाट एलएलपीको नाम हटाउँदै रजिस्ट्रारमा निवेदन दिनसक्छ.

2. Winding up of LLP: It is the process where all the assets of the business are disposed-off to meet the liabilities of the same and surplus any, is distributed among the owners. विदेशी निर्देशकहरूले भारतीय प्रमाणीकरण पदाधिकारीबाट डिजिटल हस्ताक्षर प्रमाणपत्र प्राप्त गर्न आवश्यक पर्दछ (प्रमाणीकरण निकायहरूको सूची एमसीए पोर्टलमा उपलब्ध रहेको छ). डीएससीको दर्ताको प्रक्रिया अरुका लागि लागू भएजस्तै छ.

एलएलपीको स्वीकृत नाम स्वीकृति मिति देखि 3 महिनाको अवधिका लागि मान्य हुनेछ. यदि प्रस्तावित एलएलपीलाई त्यस्तो अवधिमा समावेश गरिएको छैन भने, नाम खाली राखिनेछ र अन्य आवेदक/एलएलपीको लागि उपलब्ध हुनेछ. कृपया ध्यान दिनुहोस् कि त्यहाँ नाम नवीकरणको लागि कुनै प्रावधान हुने छैन.

ई-फारम 3 र ई-फारम 4 नयाँ र विद्यमान साझेदारहरूको नियुक्तिको लागि त्यस्तो समाप्ति वा थप शुल्क बिनाको नियुक्तिको तीस दिनभित्र र त्यसपछि थप शुल्कको साथ भर्ना गर्नुपर्दछ.
