1 बौद्धिक संपदा अधिकार

Intellectual Property Rights (IPRs) are crucial for innovation. It is the foundation of any knowledge-based economy. It is the interface of - creations and rights. It pervades through all sectors of the economy and is increasingly becoming important for ensuring competitiveness of the enterprise. Role of IPR lay in providing a legal right to the inventor to protect his/her creation as well as preventing others from illegally exploiting the creation and thus avoid re-invention of the wheel.

आविष्कारों के संरक्षण के लिए देखें IPR के विभिन्न साधन:-

  • copyright: यह रचनात्मक कार्य, जैसे संगीत, लेखन, कला, लेक्चर, नाटक, कला प्रतिकृतियां, मॉडल, फोटो, कंप्यूटर सॉफ्टवेर आदि के संरक्षण से संबंधित है.
  • पेटेंट: यह व्यावहारिक इनाेवेशन से संबंधित है और इसका लक्ष्य श्रेष्ठ, गैर-स्पष्ट और उपयोगी आविष्कारों की रक्षा करना है.
  • trademark: यह कमर्शियल चिन्हों से संबंधित है और विशिष्ट अंकों को संरक्षित करता है, जैसे, शब्द/ चिन्ह, जैसे व्यक्तिगत नाम, अक्षर, अंक, आलंकारिक तत्व (लोगो), डिवाइस, विशिष्ट रूप से दिखाई देने वाले 2डी या 3डी चिन्ह/ आकार या उनका मेल, विशिष्ट रूप से सुनाई देने वाले चिन्ह (साउंड मार्क), जैसे किसी जानवर की आवाज़ या किसी शिशु की हंसी, विशिष्ट रूप से सूंघे जाने वाले चिन्ह (स्मेल मार्क), किसी सुदंध का उपयोग.
  • इंडस्ट्रियल डिज़ाइन: यह केवल आंखों से विशिष्ट रूप से दिखाई देने और आंकलन किए जाने वाली, औद्योगिक या मैनुअल या मेकैनिकल या केमिकल प्रक्रिया (या इनके मेल से) से बनाई जाने वाली 2डी या 3डी वस्तुओं में उपयोग किए जाने वाले रंगों या लाइनों के आकार, व्यवस्था, पैटर्न, अलंकरण या रचना की नई गैर-कार्यात्मक विशेषताओं का संरक्षण करता है.
  • भौगोलिक संकेत (GI): यह औद्योगिक प्रॉपर्टी का वह पहलू है, जो प्रोडक्ट के निर्माण के स्थान या देश से संबंधित होता है. आमतौर पर, इस संबंध से प्रोडक्ट की क्वालिटी और विशिष्टता पर भरोसा बढ़ता है, जो कि केवल उसके निर्माण के स्थान, क्षेत्र, देश आदि से उत्पन्न होता है. आमतौर पर, ऐसा नाम प्रोडक्ट की क्वालिटी और विशिष्टता का भरोसा देता है, जिसका श्रेय, मूल रूप से उसके निर्माण के भौगोलिक स्थान, क्षेत्र या देश को दिया जा सकता है.

Intellectual Property Rights are always territorial. Globalization and rapid proliferation of technology has elevated the importance of intellectual property rights. 

2 बौद्धिक संपदा अधिकार के नियम व कानून

भारत, विश्व व्यापार संगठन (WTO) का संस्थापक सदस्य है और हमने बौद्धिक संपदा अधिकारों के व्यापार संबंधी पहलुओं पर समझौता (TRIPS) को मंज़ूरी दी है. समझौते के अनुसार, भारत सहित सभी सदस्य देशों को, परस्पर तय किए गए नियमों व मानकों का पालन, निर्धारित समय-सीमाओं के अंदर करना होगा. तदनुसार, भारत ने एक बौद्धिक संपदा अधिकार शासन प्रणाली बनाई है, जो WTO के अनुकूल है, और सांविधिक, प्रशासनिक व न्यायिक रूप से प्रमाणित है.

The Government has taken a comprehensive set of initiatives to streamline the intellectual property administration in the country in view of its strategic significance. The Controller General of Patents, Designs and Trade Marks (CGPDTM) under DIPP is nodal authority that administers all matters relating to patents, designs, trademarks and geographical indications and also directs and supervises the functioning of :-

  1. पेटेंट ऑफिस (डिज़ाइन विंग सहित)
  2. पेटेंट जानकारी सिस्टम (PIS)
  3. ट्रेडमार्क रजिस्ट्री (TMR), और
  4. भौगोलिक संकेत रजिस्ट्री (GIR)

इसके अलावा, मानव संसाधन विकास मंत्रालय के शिक्षा विभाग में एक 'कॉपीराइट ऑफिस' बनाया गया है, जहां कॉपीराइट एवं संबंधित अधिकारों की रजिस्ट्री जैसी सुविधाएं उपलब्ध हैं.

इंटीग्रेटेड सर्किट के लेआउट डिज़ाइन से संबंधित मामलों के लिए, सूचना प्रौद्योगिकी मंत्रालय का आईटी विभाग केंद्रीय संस्था है. कृषि मंत्रालय का 'पौधे की किस्मों का संरक्षण और किसान अधिकार प्राधिकरण' विभाग पौधों की किस्मों से संबंधित नीतियों और उपायों का प्रशासन करता है.

क. ट्रेडमार्क अधिनियम, 1999

ख. वस्तुओं का भौगोलिक संकेत (पंजीकरण और संरक्षण) अधिनियम, 1999

ग. डिज़ाइन अधिनियम, 2000

घ. पेटेंट अधिनियम, 1970 और 2002 व 2005 के उसके संशोधन

ङ. भारतीय कॉपीराईट अधिनियम, 1957 और संशोधित कॉपीराईट (संशोधन) अधिनियम, 1999

च. सेमीकंडक्टर इंटीग्रेटेड सर्किट लेआउट डिज़ाइन अधिनियम, 2000

छ. सेमीकंडक्टर इंटीग्रेटेड सर्किट लेआउट डिज़ाइन अधिनियम, 2000

3 ट्रिप्स (TRIPS)

agreement on trade related aspects of intellectual property rights (trips). it for the first time brought laws relating to intellectual property into the international trading system. this agreement narrowed down the differences existing in the extent of protection and enforcement of the intellectual property rights (iprs) around the world by bringing them under a common minimum internationally agreed trade standards. the member countries are required to abide by these standards within stipulated time-frame and promote effective protection of iprs in order to reduce distortions and impediments to international trade.
